Terms of service
These Terms and Conditions (“Terms”) govern your access to and use of the Trackside Apparel online store (“Store”) and the purchase of any products (“Products”) from us. By placing an order, you agree to be bound by these Terms. If you do not agree, do not place an order.
1. About Us & Our Products
- We are Trackside Apparel, an independent Australian business selling apparel featuring original motorsport-inspired slogans and designs.
- We are not affiliated with any motorsport team, event organiser, manufacturer, or other business.
- All Products are printed and manufactured on demand. Production and shipping timelines are outlined in Section 5.
2. Eligibility
You must be at least 18 years old or have parental/guardian consent to place an order.
3. Pricing & Payment
- All prices are in Australian Dollars (AUD) and include GST where applicable.
- Prices are subject to change without notice.
- Payment is taken at the time of order. No Products will be produced until payment is received in full.
- Any applicable international transaction fees or currency conversion fees are your responsibility.
4. Ordering
- By placing an order, you make an offer to purchase Products under these Terms.
- We reserve the right to accept or reject any order at our discretion (e.g., due to stock, suspected fraud, or technical error).
- An order confirmation email does not constitute acceptance – acceptance occurs when we dispatch your order and send a shipping confirmation.
5. Production & Shipping

- Production begins immediately after order confirmation.
- Delays due to stock shortages: You will be notified by email. We are not liable for delays beyond our control.
- International shipping: Times are estimates only. Customs delays, public holidays, and carrier performance may extend delivery. Check your tracking link for real-time updates.
- Shipping costs are calculated at checkout and are non-refundable.
- Risk in the Products passes to you when the carrier takes possession for delivery.
6. Change of Mind & Modifications
- No change of mind cancellations once production has started.
- Colour/size changes: Email us immediately after ordering. If we can intercept the order straight away due to wrong sizing you will be charged a restocking fee. We will try to accommodate if production has not begun, but there is no guarantee.
- No refunds or exchanges for change of mind after receipt.
7. Faulty or Damaged Products
- If you believe a Product is faulty, email info@tracksideapparel.com.au within 7 days of receipt with:
- Your order number
- Clear photos of the fault
- Description of the issue
- We will review and, at our sole discretion, determine if the item is faulty.
- If confirmed faulty, we will replace the item (same design/size, subject to availability) at no cost.
- No refunds will be issued for faulty items.
- Normal wear and tear, misuse, or washing contrary to care instructions do not constitute fault.
8. Sizing & Care
- Please review the sizing guide before purchase. Measurements are approximate.
- No refunds or exchanges for incorrect sizing.
- Follow garment care labels. We are not responsible for damage due to improper washing/drying.
9. Refunds (General Policy)

No refunds for:
- Change of mind
- Incorrect size selection
- Delays within stated timeframes
- Customs fees or duties
- Refunds (where applicable) will be issued to the original payment method within 14 days.
10. Intellectual Property
- All designs, slogans, logos, and content on the Store are original works owned by Trackside Apparel.
- You may not reproduce, distribute, or create derivative works without our written consent.
11. Limitation of Liability
- To the maximum extent permitted by law:
- Products are provided “as is” without warranties except as required under Australian Consumer Law.
- We are not liable for:
- Delays outside our control
- Indirect, consequential, or special losses
- Losses arising from your failure to follow care/sizing instructions
- Our total liability is limited to re-supply of the Product or cost of replacement.
12. Australian Consumer Law
- Our Products come with guarantees that cannot be excluded under the Australian Consumer Law.
- You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
- You are also entitled to have the Products repaired or replaced if they fail to be of acceptable quality and the failure is not major.
13. Privacy
- We collect and handle personal information in accordance with our Privacy Policy (available on the Store).
- By placing an order, you consent to our use of your data for order fulfilment, marketing (where you opt-in), and legal compliance.
14. Force Majeure
We are not liable for failure to perform due to events beyond our reasonable control (e.g., natural disasters, pandemics, carrier strikes, supplier delays).
15. Governing Law
These Terms are governed by the laws of Western Australia, Australia. You submit to the non-exclusive jurisdiction of WA courts.
16. Changes to Terms
We may update these Terms at any time. The updated version applies to orders placed after the “Last updated” date.
